SMS / Text Messaging Terms
CareView Monitoring operates an SMS messaging program to communicate important information related to your monitoring services. By providing your mobile phone number and opting in, you consent to receive text messages from CareView Monitoring, which may include:
Opt-Out Instructions: You may cancel SMS messages at any time. To stop receiving text messages from CareView Monitoring, reply STOP to any message you receive. After texting STOP, you will receive one final confirmation message confirming that you have been unsubscribed. No further messages will be sent unless you re-enroll.

Message & Data Rates: Message and data rates may apply. Please check with your mobile carrier for details on your plan's messaging and data charges.
Carrier Disclaimer: CareView Monitoring is not responsible for any delays or failures in the receipt of any SMS messages. Delivery is subject to effective transmission from your network operator.
Eligibility: The SMS program is available to users with a valid U.S. mobile number. By opting in, you confirm that you are the account holder or have the account holder's permission to enroll the number provided.
Use License
You are granted a non-exclusive, non-transferable, revocable license to access and use our services strictly in accordance with these terms of service.

Cancellation Policy
Termination by Parties
Either party may terminate the service agreement with written notice if the other party materially breaches the agreement and fails to cure such breach within 30 days after receipt of the breach notice.
Termination for Nonpayment
CareView Monitoring reserves the right to terminate services if payments are not made within seven days after a written notice of nonpayment is issued.
Notice and Effect of Termination
Upon termination, rights and obligations under these terms cease, except for any rights and obligations that expressly or by their nature survive termination.
Intellectual Property
The content, arrangement, and layout of this site, including, but not limited to, the trademarks, photos, logos, text, and other intellectual property contained herein, are owned by CareView Monitoring, except where noted.
Disclaimer of Warranties
The services are provided “as is”. CareView Monitoring and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement.
Limitation of Liability
In no event will CareView Monitoring, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for:
- Any special, incidental or consequential damages
- The cost of procurement for substitute products or services
- Interruption of use or loss or corruption of data
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of California, United States. Any disputes relating to these terms and conditions will be subject to the jurisdiction of the courts of California, United States.
